Mr. Charles Chatman Released

 

 

In the news this morning I read about a man named Charles Chatman, 47, Dallas Texas. He apparently has been released after serving 27 years in prison for a rape he did not commit. He was identified by the victim, when he was just 20 years old,  as she was sure he was the man who raped her.

Three times over the past 27 years he was in front of the Parole Board, each time he refused to admit guilt to the crime, and was denied parole.

Recently his DNA was submitted and it did not match the DNA sample collected from the victim at the time the crime was committed. As a result - Mr. Chatman's innocence was no longer a question in anyone's mind - he was released from prison with a feeble apology from a judge.

Now watching this short video clip about the case, I am left angry, and exasperated - even this news report is so wrong on so many levels I can't begin to explain my sheer frustration.

First off, the reporter is quick it state that the "Victim wasn't lying when she identified Chatman as her attacker, she did recognize him, only it wasn't from the rape, he happened to live in her neighbourhood"

How does the reporter know the victim wasn't lying? How does anyone know she wasn't lying? Granted during such traumatic events women are often innocently mistaken - but some have been known to flat out LIE - the reporter obviously isn't educated regarding what went on in Rosewood or many other towns where people have been mutilated, lynched, and castrated over such lies.

Next she states that this is horrible for both Mr Chatman and the victim who is obviously upset to learn her rapist was not captured. UMMMMM WHY DO WE CARE AT THIS POINT HOW UPSET SHE IS OVER HER OWN ERROR???!!! Is this reporter KIDDING ME! I don't wish that sort of violation on any woman - not ever - but like hell Imma pat her on the back because her "OOPS" 27 years ago let her attacker go free while the courts concentrated on ruining the life of an innocent man!

Another issue that is seriously bothering me is that DNA Fingerprinting was first admitted to a court of law for evidence during a case in Florida in 1988. Since then it has been virtually the back bone of the american investigation community, and has been the mitigating factor in many many cases where wrongful convictions have occurred. Why did it take almost 20 years since then to have it applied to Mr. Chatman's case? What about all the others sitting in prison waiting for DNA to exonerate them? Whats even worse to think about is - what about the wrongfully convicted who are sitting in prison somewhere in America and DNA wasn't even applicable to the crime they were convicted of? How will they prove to someone that the courts are not reliable?

Last, but certainly not least, IS SOMEONE GOING TO AT LEAST PAY MR. CHATMAN FOR THE 27 YEARS OF INCOME HE DIDN'T MAKE BECAUSE HE WAS IN JAIL ON A BOGUS CONVICTION? Lets say, for the sake of argument, that he was only going to make low income in his life for the purpose of illustrating my point here - lets say that he would have made at least 25,000 dollars a year - now over 27 years with no raise, no increases, no extra jobs, no upgrades to his education etc, just with the same income of 25G a year he stood to make at least, $675,000 dollars during that time. He went in as a 20 year old, he is coming out almost 50 years of age, his prime career building years have been stolen from him - WHO IS PAYING HIS RESTITUTION? Lets not even discuss the fact that he suffered considerably physically and mentally during this whole ordeal and is eligible for Punitive Damages - I'm just stating that he deserves AT LEAST 1 million dollars in loss of wages.

I sure hope there is a lawyer, or law student in da howse here - please phone Mr. Chatman and help him sue the American Government for this travesty that has occurred in his life. It is my understanding that some states have laws in place which prevent the wrongfully incarcerated from seeking restitution - but it is my BELIEF that the government, and those placed in the position of the administration of justice be held ACCOUNTABLE for what they do to the citizens of the country - particularly the innocent ones.

May Mr Chatman enjoy the remainder of his life in peace, and comfort.

 He and his family are permanently on my prayer list.

his sample matched the one on the victim, but it also matched 40% of the male african american general population. Also, I read where he didn't have front teeth at the time and he thought that would free him, but it obviously didn't she still picked him out because she recognized him she just couldn't remember from where. He had his most productive years snatched away from him he was only 20 years old, now he's middle aged and changed... his 'family' is on the inside...the outside family are now strangers to him...dayum. Chatman was already in jail for burgulary when they got him.
I wonder why he got so much time?
I wonder if the real rapist raped again?
I wonder how the victim feels?
Chatman is the 15th innocent person released so far...their saving grace, and why so many individuals from Texas, is a now deceased woman, who was the labratory technician at the time, kept very detailed records including samples because she knew that one day science and technology would advance beyond the tools and knowledge she had at her disposal.

I believe the reason he was identified was the fact that he was in for burgulary. She probably knew him as a trouble maker or silly kid from the neighborhood and the government then fed her his history and that just pushed her more into believing this had to be the man who raped her. It is a sad story to hear and I am deeply saddened by his loss. I pray that something is done to restore at least a portion of the justice that was snatched from him. Nothing can ever give him back 27 years of life lost to confinement of 4 walls.

The sadder part of this is that it has not changed much today, although if locked up you will probally not spend this long to proove your freedom. But you will be put in cuffs and locked up. -- I hope brothers wake up and quit givin them reasons to lock them up for anything. Its easy to not break the law. This should be a deterrent for any criminal person.

@ Studentoflife - thank you for the extra information that I didnt have. thank goodness for the foresight of the lab tech indeed! I too wonder, now that you mention it, if the rapist ever repeated the offence - my gut tells me yes unfortunately.

@ KD - whaddup mayne! lol You know you make a good point - I have a nephew who spent 2 years of his life locked up without bail,. and without a trial, while I raised his baby - cause he was walking down the street one fathers day morning to get some breakfast pastry for him and the baby and the police decided to profile him! I kid you not - that kid was in jail from the age of 18 - no record, never been arrested, went to university and had two part time jobs along with being a single father. He was just released this past xmas - his baby is now a lil man of 4.

I tell my son and my nephews all the time - be wary of your surroundings, who you are with, and where you are going. Dont let yourself be alone at ANY time with a young lady who is new to you, god knows what she gonna say when you leave her residence. Its really sad - but such a reality - that they have to always be on the alert. I tell them when they go out - go with a group and dont HANG OUT.

now they need to get the gurl and put her in jail for 27 years.. and he needs to sue them for millions as his life is basically gone... so he can at least live the rest good.. get all that backpay

I feel extremely sorry for this gentleman. In many parts of the world there has been denial of justice and many people have been convicted for crimes they did not commit. Am sure there are even many people on death row over bogus crimes.

Surely, Mr Chatman and others like him need to be paid damages despite the fact that we cannot pay for some other aspects like the emotional stress the he has gone through.Am not sure thogh if the conviction was because of his race because the judge relied on the testimony of the accuser which accuser made the horrible mistake. For her part, I believe the accuser intended to harm the young man. you cannot accuse someone when you are not very sure he committed the offence.
I know it may be hard but the best way for Mr Chatman to get some healing is to forgive all those individuals who were involved in making his life miserable.
As for suing, he can go ahead and collect damages from the federal government.We need to repent on behalf of those who made him miserable so God can have mercy on the State
